Herein please find the Terms of Business for Astor Motor Recruitment

Astor Motor Recruitment will from time to time introduce candidates to a client pursuant to a direct request by the client or at Astor Motor Recruitment’s sole initiative.  The client will be deemed to have accepted and be bound to these terms of business upon offering a position, whether permanent, temporary or time limited duration to the candidate within 12 months of accepting the CV or introduction.

Fees

  • All placements will be charged at 14% of the candidate’s annual cost to company salary, this will include any additional allowances and a 13th cheque if applicable, but not any commissions.

Guarantee

  • If, provided we receive payment on due date, an employee hired upon our introduction leaves within a 90-day guarantee period, for any other reason than redundancy, Astor Motor Recruitment undertakes to replace the candidate in the following way:
  • In the first 30 days – free of charge
  • 30 to 90 days – 25% placement fee

Replacement Policy

  • Should a candidate placed by us leave your employment within 90 (ninety) calendar days of their commencement date, we will provide one (1) replacement for the same position.
  • In the event that the replacement candidate also leaves within the same 90-day guarantee period, any further replacement for the same position will be subject to a replacement fee equal to 50% (fifty percent) of the original placement fee.
  • This guarantee is contingent on full payment of the original invoice within the agreed payment terms.
  • If we are unable to find a suitable replacement within an acceptable time period, a credit to the value of the placement fees will be passed to use on any placements and does not expire.
  • We do not offer refunds

Terms

  1. Payment becomes due on the starting date of the recommended applicant, although 10 days are given for the processing thereof.
  2. A 90-day guarantee period comes into effect on the starting date of the applicant.
  3. You validate the guarantee by making payment within 7 days of the applicant's starting date.
  4. Should you defer your hiring decision, and Astor Motor Recruitment’s recommended candidate is hired by your company or group or any of its divisions, within 12 months of the original referral date, Astor Motor Recruitment is entitled to the full sum and will invoice accordingly.
  5. In the event of you referring the candidate directly or indirectly to a third party and in the event of the third party employing the candidate, then, and in such event, you shall remain liable to Astor Motor Recruitment for the full fee as if you had employed the candidate.
  6. Whilst every care is taken by Astor Motor Recruitment in the screening, selection and reference-checking of short-listed candidates, Astor Motor Recruitment shall not be responsible or liable for any loss of whatsoever nature or kind, and however arising, from any act or omission of a candidate introduced to you by Astor Motor
  7. No concession, indulgence or extension of terms which may be allowed to you by Astor Motor Recruitment shall, under any circumstances whatsoever, be deemed to be a waiver of Astor Motor Recruitment’s rights in terms of this contract.
  8. Your acceptance of this CV shall be deemed to be acceptance of the terms and conditions herein contained and constitute the entire contract between you and Astor Motor Recruitment. No variation thereof shall be of any force or effect whatsoever unless the same has been reduced to writing and signed by both parties.

By accepting CV’s from Astor Motor Recruitment and arranging interviews with any candidates, constitutes acceptance of the Terms of Business as set out by Astor Motor Recruitment
